These responsibilities are in line with relevant legislation and the University\u2019s <a href=\"https:\/\/staffportal.curtin.edu.au\/wp-content\/uploads\/2023\/02\/HS-Management-Standards.pdf\">Health and Safety Management Standards<\/a>. <\/p>\n\n\n\n<p>The specific health and safety responsibilities of workers are dependent on their role within the University and are outlined in the <a href=\"https:\/\/www.curtin.edu.au\/about\/governance\/compliance-legal\/find-a-policy\/#h\">Health and Safety Responsibilities procedure.<\/a><\/p>\n\n\n<section          class=\"block button-block inline\" role=\"complementary\" aria-label=\"Button block\"\n         data-segment=\"all\">\n\n        \n<div class=\"block-heading hidden\" data-segment=\"dom\">\n                                <h2 class=\"block-heading__title \" id=\"button-block\">Button block<\/h2>\n            \n                        \n                        \n                            <\/div>\n\n            <a href=\"https:\/\/www.curtin.edu.au\/about\/governance\/compliance-legal\/find-a-policy\/#h\" class=\"button button--deep-blue\" target=\"_top\">Learn about your Health and Safety Responsibilities<\/a>    \n<\/section>\n\n\n\n<p>Health and safety responsibilities must be incorporated into workers position descriptions, and the associated performance criteria utilised in annual Career Conversations to determine workers performance with respect to these health and safety responsibilities.<\/p>\n\n\n<section\n                class=\"block block--no-indent cards \"\n        data-segment=\"all\">\n    \n        <div class=\"card-grid\"\n         data-card-size=\"standard\"         data-card-count=\"3\"\n         data-card-background=\"white\">\n                    <div id=\"officers\" class=\"card\"\n         data-type=\"\"><div class=\"inner\"><div class=\"card__title\"><h2 class=\"h2\">Officers<\/h2><\/div><div class=\"card__content\"><p>Having the word \u2018officer\u2019 in your work title is not what makes someone an officer under work health and safety (WHS) laws. <\/p><p>An officer is a person who makes, or participates in making, decisions that affect the whole, or a substantial part, of the organisation\u2019s activities.<\/p><\/div><div class=\"card__links\"><ul class=\"link-list link-list--magenta pink-links\"><li><a href=\"https:\/\/www.dmirs.wa.gov.au\/safety-regulation\/work-health-and-safety-laws\/main-responsibilities-and-duties-under-whs\/main-0\" aria-label=\"Your duties as an officer\"\n                                           target=\"_top\">Your duties as an officer<\/a><\/li><\/ul><\/div><\/div><\/div>                    <div id=\"workers\" class=\"card\"\n         data-type=\"\"><div class=\"inner\"><div class=\"card__title\"><h2 class=\"h2\">Workers<\/h2><\/div><div class=\"card__content\"><p>Under the\u00a0<a href=\"https:\/\/www.legislation.wa.gov.au\/legislation\/statutes.nsf\/law_a147282.html\"><em>Work Health and Safety Act 2020<\/em><\/a>\u00a0a worker is any person who carries out work for a\u00a0<a href=\"https:\/\/www.dmirs.wa.gov.au\/node\/118\/\">PCBU<\/a>, including work as an employee, contractor, subcontractor, self-employed person, outworker, apprentice or trainee, work experience student, employee of a labour hire company placed with a \u2018host employer\u2019 and volunteers.<\/p><p>As a worker, you have a &#8216;duty of care&#8217; Broadly, an officer is a person who makes, or participates in making, decisions that affect the whole, or a substantial part, of the organisation\u2019s activities. <\/p>\n<p>See interpretive guideline by DMIRS <a href=\"https:\/\/www.wa.gov.au\/system\/files\/2021-12\/211099_GL_WHSOfficers.pdf\">The health and safety duty of an officer<\/a>.<\/p>\n<p>An officer must use due diligence to ensure the <a href=\"https:\/\/www.dmirs.wa.gov.au\/safety-regulation\/work-health-and-safety-laws\/main-responsibilities-and-duties-under-whs\/main-3\">person conducting a business or undertaking (PCBU)<\/a> meets its health and safety duties to protect workers and other persons from harm.<\/p>\n\n            <\/div>\n<\/div>                    <div class=\"accordion\">\n            <button type=\"button\" class=\"accordion__heading accordion__toggle\" aria-controls=\"what-is-due-diligence\" aria-expanded=\"false\">What is due diligence?<span class=\"ico ico-chevron-fat ico--deep-blue\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewBox=\"0 0 32 32\"><path d=\"M10.91 30.41l-2.82-2.82L19.67 16 8.09 4.41l2.82-2.82L25.33 16 10.91 30.41z\"\/><\/svg><\/span><\/button>\n        <div class=\"accordion__content content\" id=\"what-is-due-diligence\" aria-hidden=\"true\">\n                    <p>Due diligence in relation to WHS means ensuring the PCBU implements and maintains appropriate and safe systems of work. This includes monitoring and evaluating how WHS is managed within the organisation.<\/p>\n<p>An officer may not be directly involved in day-to-day management, but must ensure the PCBU facilitates a safe work environment, through providing resources, creating and enforcing processes and procedures, and reviewing risks, incidents and controls.<\/p>\n\n            <\/div>\n<\/div>                    <div class=\"accordion\">\n            <button type=\"button\" class=\"accordion__heading accordion__toggle\" aria-controls=\"duties-of-an-officer\" aria-expanded=\"false\">Duties of an officer<span class=\"ico ico-chevron-fat ico--deep-blue\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewBox=\"0 0 32 32\"><path d=\"M10.91 30.41l-2.82-2.82L19.67 16 8.09 4.41l2.82-2.82L25.33 16 10.91 30.41z\"\/><\/svg><\/span><\/button>\n        <div class=\"accordion__content content\" id=\"duties-of-an-officer\" aria-hidden=\"true\">\n                    <p>Due diligence includes taking reasonable steps to:<\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\">acquire and keep up to date knowledge on work health and safety matters<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">understand the nature and operations of the work and associated hazards and risks<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">ensure the PCBU has, and uses, appropriate resources and processes to<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">eliminate or minimise risks to work health and safety<\/span><br \/>\n<span style=\"font-size: 14pt;\">ensure the PCBU has appropriate processes to receive and consider information about work-related incidents, hazards and risks, and to respond in a timely manner<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">ensure the PCBU has, and implements, processes for complying with their duties and obligations (for example, reports notifiable incidents, consults with workers, complies with notices, provides appropriate training and instruction and ensures HSRs receive training entitlements)<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">verify the provision and use of the relevant resources and processes.<\/span><\/li>\n<\/ul>\n<p>Refer to<a href=\"https:\/\/www.legislation.wa.gov.au\/legislation\/statutes.nsf\/law_a147282.html\"> s. 27(5) of the WHS Act<\/a> for a list of due diligence requirements.<\/p>\n\n            <\/div>\n<\/div>                    <div class=\"accordion\">\n            <button type=\"button\" class=\"accordion__heading accordion__toggle\" aria-controls=\"consultation-with-workers\" aria-expanded=\"false\">Consultation with workers<span class=\"ico ico-chevron-fat ico--deep-blue\"><svg xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewBox=\"0 0 32 32\"><path d=\"M10.91 30.41l-2.82-2.82L19.67 16 8.09 4.41l2.82-2.82L25.33 16 10.91 30.41z\"\/><\/svg><\/span><\/button>\n        <div class=\"accordion__content content\" id=\"consultation-with-workers\" aria-hidden=\"true\">\n                    <p>The University must, so far as reasonably practicable, consult with workers who are likely to be directly affected by health and safety matters.
