From a whole-of-University perspective, a good system of disclosure minimises the risk of corruption, misconduct and bias in the University&#8217;s operations and decision-making processes.<\/p>\n<p>The Code reflects the importance of compliance when it states under clause 6.3 &#8230;\u00a0<em>Breaches of the Code or any of the legislation, regulations, codes, policies or procedures it reflects may result in sanctions being applied by the University.<\/em><\/p>\n<p>Here are some examples of where public figures have had their integrity brought into question as a result of a failure to properly disclose conflicts of interest \/ gifts, benefits and hospitality in the course of their employment or duties:<\/p>\n<ul>\n<li><a href=\"http:\/\/www.watoday.com.au\/wa-news\/corruption-watchdog-perth-mayor-lisa-scaffidi-failed-to-disclose-gifts-20151005-gk1pdy.html\">Perth mayor failed to disclose gifts<\/a><\/li>\n<li><a href=\"http:\/\/www.brisbanetimes.com.au\/queensland\/university-of-queensland-chiefs-kid-favoured-over-343-others-20130913-2tol9.html\">UQ Vice-Chancellor&#8217;s daughter favoured for medical course<\/a><\/li>\n<li><a href=\"http:\/\/www.smh.com.au\/nsw\/greg-pearce-sacked-from-nsw-cabinet-over-conflict-of-interest-20130801-2r1f2.html\">NSW minister sacked over failing to disclose contract of interest<\/a><\/li>\n<li><a href=\"http:\/\/www.smh.com.au\/nsw\/nsw-premier-barry-ofarrell-resigns-20140416-36qwv.html\">NSW Premier resigned after failing to disclose gift<\/a><\/li>\n<li><a href=\"http:\/\/www.watoday.com.au\/wa-news\/murdoch-uni-uncovers-bullying-credit-card-misuse-big-payouts-20141113-11maoq.html\">Conflicts of interest surrounding key staff appointments &#8211; Murdoch University<\/a><\/li>\n<\/ul>\n\n        \n                            \n                    <\/div>\n<\/div>\n\n                                                                                        <div class=\"accordion\" aria-labelledby=\"accordion-title-What-sort-of-actions-would-indicate-I-have-failed-to-avoid-a-conflict?\">\n            <button type=\"button\" class=\"accordion__heading\" aria-controls=\"What-sort-of-actions-would-indicate-I-have-failed-to-avoid-a-conflict?\" aria-expanded=\"false\">\n            <div class=\"title\" id=\"accordion-title-What-sort-of-actions-would-indicate-I-have-failed-to-avoid-a-conflict?\">What sort of actions would indicate I have failed to avoid a conflict?<\/div>\n            <div class=\"icon\"><\/div>\n        <\/button>\n        <div class=\"accordion__content\" id=\"What-sort-of-actions-would-indicate-I-have-failed-to-avoid-a-conflict?\" aria-hidden=\"true\">\n                    <p>There is potential for conflicts in all aspects of University operations e.g. teaching, research, assessment, staffing and commercial activity.<\/p>\n<p>However, you also need to take reasonable steps to avoid conflicts of interest in the first place and not accept gifts, benefits or hospitality if, by doing so, a conflict would be created.. Here are some examples where the specified action indicates that reasonable steps have not been taken to avoid a conflict of interest:<\/p>\n<ul>\n<li>where you do not follow University-approved staff recruitment or supplier selection processes by personally sourcing and engaging a family member to do University work, either as a casual employee or contractor.<\/li>\n<li>where you accept a directorship in an external company or entity that you are aware supplies the University with goods or services, or is negotiating a contract to do so.<\/li>\n<\/ul>\n<p>In the above examples, engaging in the specified behaviour, disclosing the matter as a conflict and then expecting a nominated responsible officer to address the conflict would not negate the fact that you have failed to take reasonable steps to avoid getting into the situation in the first place.<\/p>\n<p>If you are unsure, its best to seek advice from your line manager or the ISU.<\/p>\n\n        \n                            \n                    <\/div>\n<\/div>\n\n                                                                                        <div class=\"accordion\" aria-labelledby=\"accordion-title-Who-decides-if-I-have-a-conflict?\">\n            <button type=\"button\" class=\"accordion__heading\" aria-controls=\"Who-decides-if-I-have-a-conflict?\" aria-expanded=\"false\">\n            <div class=\"title\" id=\"accordion-title-Who-decides-if-I-have-a-conflict?\">Who decides if I have a conflict?<\/div>\n            <div class=\"icon\"><\/div>\n        <\/button>\n        <div class=\"accordion__content\" id=\"Who-decides-if-I-have-a-conflict?\" aria-hidden=\"true\">\n                    <p>It is your responsibility to identify and disclose your own conflicts of interest (whether actual, perceived or potential), but it is the responsible officer you nominate in disclosing the conflict who makes the final decision as to whether a conflict exists and, if so, how it should be managed. This will usually be your line manager.<\/p>\n<p><a title=\"Opens in new browser window\" href=\"http:\/\/www.curtin.edu.au\/integrityandstandards\/wp-content\/uploads\/2024\/06\/Conflict_of_Interest_Procedures_-_Appendix_2.pdf\" target=\"_blank\" rel=\"noopener\">Appendix 2<\/a>\u00a0may be of assistance in helping you to determine if you need to disclose a conflict.<\/p>\n<p>There is nothing wrong with seeking advice first, or disclosing a matter which turns out not to be a conflict of interest once it has been independently assessed.<\/p>\n\n        \n                            \n                    <\/div>\n<\/div>\n\n                                                                                <div class=\"column-break\"><\/div>\n                                                                <div class=\"accordion\" aria-labelledby=\"accordion-title-Should-I-always-make-a-disclosure-to-my-manager?\">\n            <button type=\"button\" class=\"accordion__heading\" aria-controls=\"Should-I-always-make-a-disclosure-to-my-manager?\" aria-expanded=\"false\">\n            <div class=\"title\" id=\"accordion-title-Should-I-always-make-a-disclosure-to-my-manager?\">Should I always make a disclosure to my manager?<\/div>\n            <div class=\"icon\"><\/div>\n        <\/button>\n        <div class=\"accordion__content\" id=\"Should-I-always-make-a-disclosure-to-my-manager?\" aria-hidden=\"true\">\n                    <p>You need to determine the responsible officer who is best placed to make an independent decision as to whether a conflict of interest exists in relation to the matter you are disclosing, and if so, how that conflict should be managed.<\/p>\n<p>In determining how the reported conflict should by managed, the responsible officer will consider the strategies outlined in\u00a0<a href=\"http:\/\/www.curtin.edu.au\/integrityandstandards\/wp-content\/uploads\/2024\/06\/Conflict_of_Interest_Procedures_-_Appendix_3.pdf\">Appendix 3<\/a>.<\/p>\n<p>The responsible officer should usually be your line manager, but not always. It depends on the situation in which the conflict of interest arises e.g. being placed on a staff selection panel where one of the candidates is a relative or close friend would require an immediate disclosure to the Chair of the selection panel.<\/p>\n\n        \n                            \n                    <\/div>\n<\/div>\n\n                                                                                        <div class=\"accordion\" aria-labelledby=\"accordion-title-Should-I-tell-others-that-I-have-disclosed-a-conflict?\">\n            <button type=\"button\" class=\"accordion__heading\" aria-controls=\"Should-I-tell-others-that-I-have-disclosed-a-conflict?\" aria-expanded=\"false\">\n            <div class=\"title\" id=\"accordion-title-Should-I-tell-others-that-I-have-disclosed-a-conflict?\">Should I tell others that I have disclosed a conflict?<\/div>\n            <div class=\"icon\"><\/div>\n        <\/button>\n        <div class=\"accordion__content\" id=\"Should-I-tell-others-that-I-have-disclosed-a-conflict?\" aria-hidden=\"true\">\n                    <p>If you have formally registered a conflict, and\u00a0<strong>knowledge of that conflict could impact later on a process being run or a decision being made<\/strong>\u00a0by another University officer in the course of their duties, you are obliged to inform that officer of the matter.<\/p>\n<p>Failure to do so could be viewed as a breach of these procedures and the Code, particularly if you are unduly advantaged (financially or otherwise) or the University disadvantaged by your failure to inform the relevant officer.<\/p>\n\n        \n                            \n                    <\/div>\n<\/div>\n\n                                                                                        <div class=\"accordion\" aria-labelledby=\"accordion-title-Do-I-have-to-disclose-the-same-conflict-every-year?\">\n            <button type=\"button\" class=\"accordion__heading\" aria-controls=\"Do-I-have-to-disclose-the-same-conflict-every-year?\" aria-expanded=\"false\">\n            <div class=\"title\" id=\"accordion-title-Do-I-have-to-disclose-the-same-conflict-every-year?\">Do I have to disclose the same conflict every year?<\/div>\n            <div class=\"icon\"><\/div>\n        <\/button>\n        <div class=\"accordion__content\" id=\"Do-I-have-to-disclose-the-same-conflict-every-year?\" aria-hidden=\"true\">\n                    <div>\n<p>Provided there are\u00a0<strong>no changes in the circumstances<\/strong>\u00a0that resulted in your conflict being disclosed and addressed earlier, you do not have to re-register the same disclosure to the same responsible officer.<\/p>\n<\/div>\n\n        \n                            \n                    <\/div>\n<\/div>\n\n                                                                                        <div class=\"accordion\" aria-labelledby=\"accordion-title-What-happens-if-the-circumstances-of-my-disclosed-conflict-change?\">\n            <button type=\"button\" class=\"accordion__heading\" aria-controls=\"What-happens-if-the-circumstances-of-my-disclosed-conflict-change?\" aria-expanded=\"false\">\n            <div class=\"title\" id=\"accordion-title-What-happens-if-the-circumstances-of-my-disclosed-conflict-change?\">What happens if the circumstances of my disclosed conflict change?<\/div>\n            <div class=\"icon\"><\/div>\n        <\/button>\n        <div class=\"accordion__content\" id=\"What-happens-if-the-circumstances-of-my-disclosed-conflict-change?\" aria-hidden=\"true\">\n                    <p>You should inform both the ISU and the responsible officer who you originally submitted your conflict notification to if any changes arise that may:<\/p>\n<ul>\n<li>alter that responsible officer&#8217;s original decision that there was no conflict to be addressed; This may be between yourself and another staff member, or between yourself and a student.<\/p>\n<p>It is imperative that you recognise when this happens and take immediate action to register a conflict of interest.<\/p>\n<p>Moreover, as described above, you need to be aware that it is also\u00a0<strong>contrary to the procedures to take any action which would be seen as having failed to take reasonable steps to avoid a conflict of interest when dealing with people with whom you have a close personal relationship.<\/strong>\u00a0e.g. personally selecting or influencing the selection of your partner as a casual research assistant on your research project. If you are unsure, then simply don&#8217;t accept it, or return or repay it if already received. Under such circumstances, it is not necessary to proceed any further in relation to disclosure via the system.<\/div>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<div>If the answer is \u201cNo\u201d, then proceed as follows. Determine the value of the gift:<\/div>\n<\/li>\n<\/ul>\n<ol>\n<li>\n<div>If it is valued at less than or equal to $150\u00a0<strong>and<\/strong>\u00a0if by accepting the gift, the total value of gifts received by you from the same individual or organisation would not exceed $300 within a 12 month period, then you may keep the gift and it is not mandatory to make a disclosure via the system. Note: under these circumstances, you may still wish to make a disclosure for recordkeeping purposes and to keep track of gifts received over a 12 month period from the same individual or organisation (your line manager \/ responsible officer will not be notified of these disclosures by the system).<\/div>\n<\/li>\n<li>\n<div><strong>For all other situations (i.e. regardless of the gift\u2019s value), disclosure is mandatory<\/strong>\u00a0and your disclosure will be directed by the system to either your line manager or Executive Manager for a decision to be made.<\/div>\n<\/li>\n<\/ol>\n<p>Note that the Conflict of Interest System automatically guides you through the above process, based on the responses you provide to questions that arise from the electronic gift processing workflow.<\/p>\n\n        \n                            \n                    <\/div>\n<\/div>\n\n                                                                                        <div class=\"accordion\" aria-labelledby=\"accordion-title-How-are-sponsorship-benefits-different-to-gifts?\">\n            <button type=\"button\" class=\"accordion__heading\" aria-controls=\"How-are-sponsorship-benefits-different-to-gifts?\" aria-expanded=\"false\">\n            <div class=\"title\" id=\"accordion-title-How-are-sponsorship-benefits-different-to-gifts?\">How are sponsorship benefits different to gifts?<\/div>\n            <div class=\"icon\"><\/div>\n        <\/button>\n        <div class=\"accordion__content\" id=\"How-are-sponsorship-benefits-different-to-gifts?\" aria-hidden=\"true\">\n                    <p>Some sponsorship arrangements between the University and third parties may include the provision of discounted or free goods or services, or contra (exchanged items). Similar benefits may arise from University contracts with preferred suppliers of goods and services e.g. discounted airline tickets or accumulated sales reward points converted to free equipment etc.<\/p>\n<p>In all such cases,\u00a0<strong>these benefits are not to be treated as gifts<\/strong>. This is different to\u00a0<strong>foreign influence<\/strong>, which involves activities conducted in an open and transparent manner as part of regular international relations and diplomacy, and which can contribute positively to public debate.<\/p>\n<p>The Federal Government\u2019s\u00a0<a href=\"http:\/\/www.curtin.edu.au\/integrityandstandards\/wp-content\/uploads\/2024\/06\/ESE21-0359-UFIT-Guidelines-Refresh_ACC3.pdf\">Guidelines to Counter Foreign Interference in the Australian University Sector<\/a>\u00a0(<strong>the Guidelines<\/strong>) are designed to strengthen resilience to foreign interference in the University sector. The Disclosure of Interest Procedures implement the Guidelines\u2019 recommendations for disclosure of specific Foreign Relationships and Interests.<\/p>\n<p>The Foreign Relationships and Interests disclosure questions in the online Disclosure of Interest Register will also help individuals to determine whether they have personal registration obligations under the\u00a0<em>Foreign Influence Transparency Scheme Act 2018<\/em>\u00a0(Cth).<\/p>\n<p>Foreign Relationships and Interests requiring disclosure include:<\/p>\n<p>\u00b7\u00a0any financial support (cash or in-kind) for education or research related activities from a country other than Australia;<\/p>\n<p>\u00b7\u00a0any position (paid or unpaid), honorific titles, or any other obligations to a foreign university, academic organisation or company, (eg, membership of a foreign talent recruitment program);<\/p>\n<p>\u00b7\u00a0any association or affiliation with a foreign government or foreign military, policing or intelligence organisation; or<\/p>\n<p>\u00b7\u00a0any lobbying, public communications activities or disbursement activities conducted on behalf of a foreign government, foreign government related individual or entity, or foreign political organisation, for the purpose of political or government influence.<\/p>\n<p>The obligation to disclose Foreign Relationships and Interests is separate from, and in addition to, disclosure obligations regarding Conflicts of Interest. It is an individual\u2019s responsibility to disclose Foreign Relationships and Interests whether or not they consider that these may also involve a Conflict of Interest.
